This website, which is reached via the domain nalika.com (referred to as “website”), is owned and run by Baechtold Limited incorporated at 12/2 Phaholyothin 37, Bangkok, Thailand (referred to as “Baechtold/we/our/us”). This website is intended for use by customers in Thailand, both resident and non-resident. We make no claim that the contents of this website are appropriate or applicable for use in any other countries.
You (referred to as “you” or “your”) are a user of this websites. By using our website you affirm that you have read, understood and accepted to be bound by our terms published herein. If you do not agree with these terms do not use this website. If you are accessing this website from outside of Thailand this is at your own responsibility and you are responsible for compliance with local laws resulting from your use of this website.

ONLINE SHOP - ORDERING AND PAYMENT TERMS

This website is an online showcase and shop designed to facilitate communication between Baechtold and you for information purposes and/or to prepare for a purchase transaction. Our products being of high value, we apply caution to the exchange of information and/or to a transaction and its preparation. By using this website you accept to apply the same caution. Baechtold suggests that you obtain as much information as you need from this website or by contacting us, and if possible make an appointment with us to physically inspect a product or a service before you enter into a financial transaction and take physical delivery. Nothwithstanding this, if you chose to place an order and make a payment based on the information provided on this website, we will exercise utmost care to provide you with the offered products and services. You will be bound by your order once you have made full payment to us. However, we will only be bound by our offer once we have confirmed availability, condition and price of a product or service by sending you an Order Confirmation.
Upon receipt of your contact/inquiry/order we will send you an acknowledgement which will be non-binding for us until we have sent you a written Order Confirmation. Baechtold reserves the right not to accept a contact/inquiry/order for any reasons whatsoever. If you do not receive an answer or an Order Confirmation from us within 5 working days of sending us an inquiry or order, your order is considered cancelled. If we have received your payment already you are entitled to a refund.
All published prices are non-binding for Baechtold until we confirm our offer by written Order Confirmation. Baechtold reserves the right to change prices at any time prior to sending you an Order Confirmation, in which case you have the right to change or cancel your order within 3 days of receiving our Order Confirmation. Baechtold will confirm the delivery time for each order and the delivery date will be valid from the moment you accept an Order Confirmation in writing. We make every effort to deliver on time and in one shipment to minimize charges. Partial deliveries are allowed. We are not liable for damages resulting from any delay or failure to deliver, other than the obligation to deliver the product or service or refund the payment to you. Baechtold remains the proprietor of the products and services until all obligations are settled by you, including the payment.
By placing an order through our website or by other means you are entering a binding obligation to pay for and accept delivery of products or services you order. Our agreement to sell to you is confirmed when we send you our written Order Confirmation and once we receive your payment and any information mandated by Thai law, including your name, identity No. contacts and address. We reserve the right to cancel an order before delivery for any reason whatsoever and to refund your payment to you.
You can chose to pay by credit card, bank transfer, or any other agreed method of payment. Your payment is made at your own risk. Your payment is deemed received when the amount has been credited to an account of ours and your full personal contact information has been provided by you according to Thai legal requirements.
Your right of cancellation or return of a product is subject to prevailing Thai laws, and to the agreement between Baechtold and you. Any cancellation must be communicated in writing. In case of cancellation and if the products or services are items which have not been specially ordered or made specifically for you, we accept a cancellation prior to delivery against a refund, but subject to the deduction of handling and other expenses. For products and services which have been specially ordered and/or produced for you, we do not accept any cancellation or refund. Any returned products need to be in original and unused condition accompanied by the original packaging and documentation. Returns must be made to us. Refunds will be made by us. You will need to contact us to arrange for the best method of return. Your are entitled to get a refund or make an exchange only once we have received the products in original and unused condition including packaging.
If we get back products form you that are not in original or unused condition including packaging, or if damaged or incomplete, a refund is not possible. We may then offer you a partial refund or renegotiate your acceptance.
Delivery is according to your preference and takes place at the confirmed delivery time only after we have received your payment. The acceptance of the delivery is your obligation. If you refuse to accept delivery you are considered in default of your obligation and the product will be stored at your expense pending your acceptance.
Our prices include Thailand taxes including Thailand VAT at the prevailing rate. Baechtold may charge for packaging, shipping or delivery, and insurance. If you are a customer in Thailand but not a resident of Thailand, you may qualify for a VAT refund upon taking the products out of Thailand. Please notify us accordingly so that we can propose tax refund documents to you.
Baechtold is not liable for any economic losses, loss of goodwill, or other and special losses incurred by any party arising out of or in connection with the provisions of any matter under these terms.
GUARANTEE
We guarantee all our products and services for a specificy time or use, as communicated with each purchase. Our guarantee may cover materials as specified in the guarantee card as well as defects that are due to manufacturing mistakes. Damages caused by third parties are excluded from our obligation. It is your obligation to check products or services on receipt and to ensure that they have no defects and that that they correspond to your order and to details specified in the accompanying documents. In case of damages from transportation you must inform the delivery company immediately of any defects. In case of other defects or damages you must inform Baechtold within 7 days after delivery in writing. We reserve the right to repair defective goods up to 3 times, or to replace them if possible.
In case of a claim you will need to describe the damage, defect or problem. Delivered products may vary in appearance from those shown on our website, especially with regard to color tones. Such discrepancies are not considered as defects. In general, measurements mentioned on our website are approximate though we try to communicate them as accurately as possible.

Baechtold reserves the right to transfer, assign or sub-contract the benefit of the whole or part of any of its rights or obligations under these terms or any related contract to any third party.
If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms shall not be affected.
These terms supersede all prior representations, understandings and agreements between you and Baechtold relating to the use of our Online Shop.
